  1. Pick any law in which you have an interest. I will be happy to discuss ahead of time the law that you are considering. The more narrow the law, the easier it will be to analyze. You may pick some part of a law in order to narrow it down, for example the enforcement part of a particular law.
  2. State the problem that you believe is the cause of the law that you are considering. Think broadly. Is the problem discussed in the law only a symptom or partial solution to a larger problem? Is it only a problem depending on the philosophy of the lawmaker? Do you need to ask more questions in order to determine if there is a larger problem? Remember that a problem is objectively stated, goes to the heart of the controversy and is in the form of a question such as “how does a society balance its interest in… ‘ and reflects the competing interests involved.
  3. Give the individuals and entities that you see as having an interesting the solution to the problem. How do the conflicting interests form the basis for the problem that must be addressed?
  4. State the facts that you would need in order to give a solution to the problem. What facts are you assuming in order to move ahead, and why are you assuming them. State how your analysis would change if you changed your assumptions.
  5. What would be the free market solution to the problem? Remember that the free market perspective can allow government intervention if it has the purpose of making the market free. Be specific about how the free market could be used to solve the problem.
  6. What would the communitarian solution be? This approach sets a goal. What would it be? You should refer to the problem that you have discussed in number 1. What questions would the communitarian ask and how would the answers affect the decision made?
  7. How would other philosophies affect the solution? Remember to think in broad terms, for example there are philosophies of an eye for an eye or that society has responsibility for all of the needs of its citizens or that parents not the government should decide everything for their children. Look at philosophies that are different from your own a well as those that are the same.
  8. What is your solution to the problem? This is the most important part. Give your reasoning, arguments that are for and against your solution. Consider the philosophies discussed above, and give reasons for why you have or you have not chosen these approaches. Discuss how the short and long term aspects of the problem are addressed in your solution. Discuss whether or not there are problems in enforcing the law that you propose. Should the problem be addressed on the local, state or federal level and enforced by the courts or administrative agencies? State whether or not you are making your law very specific or general, and of course for all of the above, give your reasons.
  9. If you are using any sources for your paper, be sure to use footnotes and a bibliography.
